The Africa Journal of Health and Environmental Law (AJHEL) is committed to maintaining high standards of academic quality, research integrity, editorial independence, transparency and ethical scholarly publishing.

This Publication Policy establishes the principles governing the submission, evaluation, review, acceptance, publication, correction and preservation of scholarly work published by AJHEL.


1. PURPOSE OF THE PUBLICATION POLICY

The purpose of this policy is to ensure that AJHEL maintains a scholarly publication environment based on:

  • Academic excellence;
  • Originality;
  • Research integrity;
  • Rigorous peer review;
  • Editorial independence;
  • Transparency;
  • Accountability;
  • Confidentiality;
  • Ethical research;
  • Respect for human rights; and
  • Responsible environmental scholarship.

2. JOURNAL SCOPE

AJHEL publishes scholarly work addressing the intersection of:

  • Health law;
  • Public health;
  • Environmental law;
  • Environmental protection;
  • Human rights;
  • Environmental justice;
  • Healthcare regulation;
  • Climate change;
  • Bioethics;
  • Public policy;
  • Governance; and
  • Sustainable development.

The Journal gives particular attention to African legal, health, environmental and governance realities, while welcoming comparative and international perspectives relevant to Africa.


3. ORIGINALITY OF SUBMISSIONS

Manuscripts submitted to AJHEL must be original scholarly works.

A manuscript must not:

  • Have been previously published in substantially the same form;
  • Be simultaneously submitted to another journal;
  • Contain plagiarised material;
  • Misrepresent another person's research as the author's own; or
  • Reproduce substantial previously published material without appropriate acknowledgement.

Authors must disclose any related publication or manuscript that may substantially overlap with the submitted work.


4. EXCLUSIVE SUBMISSION

Authors must not submit the same manuscript simultaneously to AJHEL and another journal.

Where an author wishes to withdraw a manuscript from AJHEL before submitting it elsewhere, the author should formally notify the Editorial Office.


5. TYPES OF PUBLICATIONS

AJHEL may publish:

  • Original Research Articles;
  • Legal and Doctrinal Articles;
  • Empirical Research;
  • Comparative Studies;
  • Policy Analysis;
  • Regulatory Analysis;
  • Interdisciplinary Research;
  • Systematic and Scholarly Reviews;
  • Case Commentaries;
  • Legislative Commentaries;
  • Policy and Practice Papers;
  • Short Research Communications; and
  • Scholarly Book Reviews.

The Editorial Board determines the appropriate publication category.


6. EDITORIAL INDEPENDENCE

Editorial decisions are based primarily on:

  • Scholarly quality;
  • Originality;
  • Relevance;
  • Methodological soundness;
  • Legal and analytical quality;
  • Research integrity; and
  • Contribution to the Journal's scope.

Editorial decisions must not be improperly influenced by:

  • Financial considerations;
  • Political interests;
  • Personal relationships;
  • Institutional affiliations;
  • Nationality;
  • Gender;
  • Religion;
  • Academic rank; or
  • Commercial interests.

7. PEER REVIEW

Research manuscripts requiring external evaluation are subject to AJHEL's peer-review process.

The Journal normally uses double-blind peer review, with at least two independent reviewers for research articles.

The detailed procedure is provided in the Journal's Peer Review Policy and Peer Review Process.


8. AUTHORSHIP

Authorship must reflect genuine intellectual contribution to the research and manuscript.

Authors should have made substantial contributions to one or more of:

  • Research conception;
  • Research design;
  • Data collection;
  • Legal analysis;
  • Data analysis;
  • Interpretation;
  • Drafting; or
  • Substantive revision.

All listed authors should approve the final manuscript and agree to its submission.


9. GUEST, GIFT AND HONORARY AUTHORSHIP

AJHEL does not support:

  • Gift authorship;
  • Honorary authorship;
  • Guest authorship; or
  • Authorship based solely on institutional position or seniority.

Individuals who contributed substantially but do not meet authorship requirements may be acknowledged where appropriate.


10. AUTHORSHIP CHANGES

Requests to add, remove or reorder authors after submission must be justified.

The Editorial Office may require written confirmation from all affected authors before approving an authorship change.

Where an authorship dispute cannot be resolved by the authors, AJHEL may refer the matter to the relevant institution or competent authority.


11. CORRESPONDING AUTHOR

The corresponding author is responsible for communication between the authors and the Editorial Office.

The corresponding author should ensure that:

  • All authors have approved the manuscript;
  • Author information is accurate;
  • Required declarations are complete;
  • Reviewer comments are communicated to co-authors;
  • Revisions are properly coordinated; and
  • The final version is approved by all authors.

12. RESEARCH ETHICS

Research involving human participants, patients, health records, interviews, surveys, vulnerable populations or other sensitive information must comply with applicable ethical standards.

Where applicable, authors should provide information concerning:

  • Ethical approval;
  • Institutional approval;
  • Informed consent;
  • Participant confidentiality;
  • Data protection;
  • Anonymisation; and
  • Other relevant ethical safeguards.

AJHEL may request evidence of ethical approval where appropriate.


13. MEDICAL AND HEALTH RESEARCH

Authors conducting health or medical research must ensure that their research complies with applicable:

  • National health regulations;
  • Institutional ethical requirements;
  • Research ethics standards;
  • Patient-protection requirements; and
  • Data-protection requirements.

Patient identities and confidential health information must be protected.


14. ENVIRONMENTAL RESEARCH

Environmental research should comply with relevant environmental laws, regulations, permits and institutional requirements.

Where appropriate, authors should disclose:

  • Environmental approvals;
  • Research permits;
  • Sampling procedures;
  • Environmental safeguards;
  • Community consultation; and
  • Relevant ethical considerations.

Research should not knowingly cause unnecessary environmental harm.


15. HUMAN RIGHTS AND VULNERABLE POPULATIONS

Research involving vulnerable groups should receive appropriate ethical consideration.

Authors should take particular care when research involves:

  • Children;
  • Indigenous communities;
  • Persons with disabilities;
  • Refugees;
  • Internally displaced persons;
  • Patients;
  • Low-income communities;
  • Marginalised populations; or
  • Other vulnerable groups.

16. CONFLICT OF INTEREST

Authors, reviewers and editors must disclose actual, potential or perceived conflicts of interest.

Potential conflicts may include:

  • Financial relationships;
  • Employment;
  • Consultancy;
  • Research funding;
  • Institutional interests;
  • Personal relationships;
  • Professional competition; or
  • Commercial interests.

A conflict does not necessarily prevent publication, but it must be appropriately disclosed and managed.


17. FUNDING DISCLOSURE

Authors must disclose financial support received for the research.

The disclosure should identify the funding organisation and, where applicable, the relevant grant or project.

Where there is no external funding, authors may state:

"This research received no external funding."


18. DATA AND MATERIALS

Authors should retain appropriate research records and supporting materials.

Where applicable, authors should provide information concerning the availability of:

  • Research datasets;
  • Research instruments;
  • Statistical outputs;
  • Analytical procedures;
  • Software or code; and
  • Other supporting materials.

Data involving personal health information or confidential research participants must not be disclosed where doing so would violate ethical, legal or privacy requirements.


19. PLAGIARISM AND ACADEMIC MISCONDUCT

AJHEL maintains strict standards against plagiarism and research misconduct.

Prohibited conduct includes:

  • Plagiarism;
  • Fabrication;
  • Falsification;
  • Duplicate publication;
  • Citation manipulation;
  • Fabricated references;
  • Fabricated legal authorities;
  • Improper authorship;
  • Copyright infringement; and
  • Manipulation of peer review.

Suspected misconduct will be handled according to AJHEL's relevant publication-ethics policies.


20. ORIGINALITY SCREENING

Submitted manuscripts may be screened using appropriate plagiarism or originality-detection tools.

A similarity score alone does not establish plagiarism.

The Editorial Board considers the nature, extent and context of identified similarities.


21. GENERATIVE AI

AJHEL recognises that generative artificial intelligence can assist scholarly work but requires responsible use.

AI systems cannot be listed as authors.

Authors remain responsible for:

  • Accuracy;
  • Originality;
  • Research findings;
  • Medical claims;
  • Environmental claims;
  • Legal authorities;
  • References;
  • Data; and
  • Conclusions.

Where AI has been used substantially in preparing a manuscript, authors should provide the appropriate disclosure required by the Journal's Generative AI Policy.

AI must not be used to fabricate data, references, legal authorities, research findings or evidence.


22. CITATION AND REFERENCES

Authors must accurately acknowledge all sources used in their research.

References should be:

  • Relevant;
  • Accurate;
  • Verifiable;
  • Consistently formatted; and
  • Appropriate to the subject.

AJHEL generally recommends APA 7th edition for interdisciplinary research, while appropriate legal citation systems may be used for doctrinal legal scholarship.


23. CITATION MANIPULATION

Authors, reviewers and editors must not manipulate citations for the purpose of artificially increasing:

  • Citation counts;
  • Journal metrics;
  • Author metrics; or
  • Institutional rankings.

Citations should be included because they are genuinely relevant to the scholarly argument.


24. REVIEWER CONFIDENTIALITY

Reviewers must treat manuscripts as confidential.

Reviewers must not:

  • Share unpublished manuscripts;
  • Use unpublished information for personal advantage;
  • Contact authors directly without permission;
  • Disclose reviewer assignments; or
  • Use confidential research information for competing work.

25. EDITORIAL CONFLICTS OF INTEREST

Editors must disclose and appropriately manage conflicts of interest.

An editor should not handle a manuscript where a personal, professional, financial or institutional relationship could compromise editorial independence.

Where necessary, the manuscript should be transferred to another qualified editor.


26. PUBLICATION DECISIONS

The final decision to publish a manuscript rests with the Editor-in-Chief or an authorised editor.

The decision may take into account:

  • Peer-review reports;
  • Manuscript quality;
  • Ethical compliance;
  • Originality;
  • Relevance;
  • Author responses;
  • Legal and methodological quality; and
  • Overall contribution to AJHEL.

27. ACCEPTANCE AND PRODUCTION

After acceptance, manuscripts may undergo:

  • Copyediting;
  • Language editing;
  • Reference checking;
  • Formatting;
  • Typesetting;
  • Proofreading; and
  • Metadata preparation.

Editorial or production corrections do not normally alter the substantive scholarly conclusions of an accepted article.


28. AUTHOR PROOFS

Authors may receive proofs for final checking.

Authors should carefully verify:

  • Names;
  • Affiliations;
  • Tables;
  • Figures;
  • References;
  • Legal citations;
  • Statistical information; and
  • Other factual details.

Major substantive changes should not normally be introduced at the proof stage without editorial approval.


29. OPEN ACCESS

AJHEL operates an Open Access publishing model.

Published articles are made available online without subscription or paywall barriers, subject to the applicable licence.

The standard Article Processing Charge is:

USD 100 PER ACCEPTED ARTICLE/PAPER

There is no submission fee.

The APC is payable only after acceptance.


30. COPYRIGHT AND LICENSING

Unless otherwise stated, AJHEL articles are published under the applicable Open Access licence, normally:

Creative Commons Attribution 4.0 International (CC BY 4.0).

Authors retain appropriate rights in their scholarly work subject to the publication agreement and licence.

Readers may reuse material according to the applicable licence, provided appropriate attribution is given.


31. CORRECTIONS AND ERRATA

AJHEL is committed to maintaining an accurate scholarly record.

Where an error is identified, the Journal may publish:

  • Erratum;
  • Corrigendum;
  • Correction;
  • Expression of Concern; or
  • Retraction.

The appropriate action depends on the nature and significance of the problem.


32. RETRACTION

AJHEL may retract an article where serious problems undermine its reliability or integrity.

Potential grounds include:

  • Fabricated data;
  • Falsified findings;
  • Serious plagiarism;
  • Duplicate publication;
  • Serious ethical violations;
  • Major undisclosed conflicts of interest;
  • Manipulated peer review; or
  • Fundamental errors affecting the validity of the article.

A retraction notice will normally remain linked to the original publication to preserve the scholarly record.


33. ALLEGATIONS OF MISCONDUCT

Allegations concerning research or publication misconduct will be handled fairly, confidentially and objectively.

AJHEL may:

  • Investigate the allegation;
  • Request an author response;
  • Consult independent experts;
  • Contact relevant institutions;
  • Publish an Expression of Concern;
  • Issue a correction; or
  • Retract an article where appropriate.

An allegation is not automatically considered proof of misconduct.


34. APPEALS

Authors may appeal an editorial decision where they have reasonable grounds to believe that:

  • A significant procedural error occurred;
  • Important evidence was overlooked;
  • A serious conflict of interest affected the decision; or
  • The manuscript was materially misunderstood.

Appeals should be submitted with specific reasons and supporting information.


35. COMPLAINTS

Complaints concerning editorial procedures, publication ethics, peer review or other publication matters should be submitted to the Editorial Office.

AJHEL will endeavour to address legitimate complaints promptly, fairly and confidentially.


36. RECORD PRESERVATION

AJHEL seeks to maintain reliable records of:

  • Published articles;
  • Corrections;
  • Retractions;
  • Editorial decisions;
  • Article metadata; and
  • Other relevant publication information.

Where technically possible, corrections and retractions will remain linked to the original publication.


37. INDEXING AND DISCOVERABILITY

AJHEL seeks to improve the discoverability of its scholarship through appropriate scholarly indexing and research-discovery services.

The Journal may pursue inclusion in relevant services such as:

  • Google Scholar;
  • Crossref;
  • OpenAlex;
  • DOAJ;
  • African Journals Online (AJOL);
  • EBSCO;
  • ProQuest;
  • HeinOnline;
  • Scopus; and
  • Web of Science.

The Journal will not claim formal indexing in any database until inclusion has been officially confirmed.


38. POLICY REVIEW

This Publication Policy may be periodically reviewed by the Editorial Board and Publisher to reflect developments in:

  • Scholarly publishing;
  • Research ethics;
  • Health law;
  • Environmental law;
  • Open Access;
  • Artificial intelligence;
  • Data protection;
  • Research integrity; and
  • International publishing standards.
